Posh Myths one should know

1.Myth:

Organizations should have female staff to have posh implementation and maintain as compliance

Fact:

Posh act says it is not necessary to have female staff in organization. The Posh act protects every women who visit your office for short duration work like business meeting, personal visitor, or for an interview.

2.Myth:

The accused will lose job as Punishment as “Termination of Services”

Fact:

There are many punishments for minor act of Sexual Harassment or it depends on severity of complaint.

i.e. Apology, Warning letter, Counseling, withholding promotion,

3.Myth:

I being accused will lose respect

 Fact:

Posh Act section 16 & 17 says to maintain confidentiality.  Failure to do so act imposes penalty.  Act ensures Complainant, Respondent and witness protected as well.

4.Myth:

My organizations have only 20 employees I do not require Internal Committee

Fact:

Any organization that has more than 10 employees irrespective of gender must constitute Internal Committee.

5.Myth:

Posh law does not applicable to employees work from home or remotely

Fact:

Under the Posh Act definition of Workplace has been defined as Offices, branches, institutions, Units, Official visiting places, transportation.

At time of Covid Lockdown and work from home culture started Posh Act says Home is workplace.  

6.Myth:

The Recommendation of the Internal Committee is suggestion for management.

Fact:

As per Posh Act Recommendation of IC is Mandatory to implement by management within 60 days of receiving it by Internal Committee.

7.Myth:

Posh complaints are registered those cases which held within organization premises.

Fact:

Posh Act Internal Committee take all the cases which arises as part of employment activities like travelling, meeting, hotel stay, cabs, official parties and all

Posh Law protects only women from Sexual Harassment

Fact:

It is true Posh Law gives protection to women for sexual harassment under Posh Act.

But organizations make Gender-neutral Policy for it employees. This will allow organizations to take care of men protection against Sexual Harassment.

9. Myth:

According to Posh Law Sexual Harassment is when a Man Sexually Harasses Woman

Fact:

Complainant is Aggrieved Women and Respondent is Man, according to Posh Act Respondent can be a man or a woman or third gender.

10. Myth:

Women if say NO, we can ask again or if woman keep quite does shows she is ready/ YES is not sexual Harassment

Fact:

This is common myth and excuse by men to justify one sided sexual interest/Friendship
